Parmon S.p.A., with registered office in C.da Piraino, S.S.192 Km 73, 95032, Belpasso (CT) - enrolled in the Companies' Register with tax code and VAT no. 02318140874, pursuant to Article 13 of EU Regulation no. 679/2016 (General Data Protection Regulation), acts as Data Controller for the processing of the data you provide when registering on the yducare.com website and/or other websites that the Company may create over time (hereinafter referred to as "the Website"):

A. PURPOSE OF PROCESSING

Personal data are collected and used for the following purposes: (1) for the registration to the Website and for purposes related to the use of the Website as well as for the use of services reserved to registered users including, but not limited to, the purchase and/or reservation and/or order of products online and the possibility to receive Newsletters/DEMs (e- mail marketing) communicating commercial and/or institutional initiatives. Geolocation data will be used exclusively for the purpose of ensuring the proper functioning of our location search service and will be processed by means of computer tools and special databases, stored exclusively and limited to the period of time necessary to achieve the purposes for which the data were collected. The legal basis for this processing is the performance of a contract to which the User is a party. In connection with this purpose, your data will be stored for the entire duration of the contract and for 10 years after the end of the contract.

Subject to your consent, personal data may be processed for: (2) marketing purposes including sending advertising material, direct sales, commercial communication by e-mail, SMS/MMS, calls without operator (if you have provided your mobile phone number), through the Website (possibly personalised), social media platforms etc. and/or for sending the newsletter (periodic communication sent by e-mail to the address to be indicated, through which registered users will be informed of the exclusive initiatives that the Data Controller will make available to its registered users, such as, purely by way of example and not exhaustive or binding, exclusive services, blogs, forums, discussion areas, invitations, etc.). The personal data that will be processed are:

D. OBLIGATORY OR OPTIONAL NATURE OF PROVIDING DATA AND CONSEQUENCES OF A REFUSAL TO ANSWER

The personal data required for registration on the Website and identified with an asterisk in the registration forms are necessary to allow registration to take place, just as the data required to allow use of the online sales and/or booking and/or ordering functionality are necessary. Unnecessary personal data are not identified with an asterisk in the registration form and may not be provided without any consequences. F. RIGHTS OF THE DATA SUBJECT

By submitting a written request via the contacts indicated at yducare.com, the User may ask the controller for access to the data concerning him/her, their deletion, the rectification of inaccurate data, the integration of incomplete data, the restriction of processing in the cases envisaged by Article 18 GDPR, as well as the objection to processing, for reasons related to his/her particular situation, in cases of legitimate interest of the controller. Furthermore, in the event that the processing is based on consent or contract and is carried out by automated means, the User has the right to receive the data in a structured, commonly used and machine-readable format, as well as, if technically feasible, to transmit them to another data controller without hindrance. The User has the right to withdraw consent given at any time for marketing and/or profiling purposes, as well as to object to the processing of data for marketing purposes, including profiling related to direct marketing. If the User prefers to be contacted for the above-mentioned purpose exclusively by traditional means, he/she may object only to receiving communications by automated means. Finally, the User has the right to lodge a complaint with the competent supervisory authority in the Member State where he or she normally resides or works or in the State where an alleged infringement has occurred.

G. DATA CONTROLLER AND PROCESSOR

GENERAL CONDITIONS FOR USE OF THE WEBSITE

All Users, whether registered or not, are obliged to carefully read the following General Terms and Conditions of Use of the Website (hereinafter the "GTC") in order to take advantage of the services and products offered by yducare.com (hereinafter the "Website").

B. CONTENT OF THE WEBSITE

The Website provides commercial and institutional information and initiatives related to the products marketed on the platform operated by Ydu Care. The Website may also offer Services governed by different general conditions that will be published from time to time in order to allow access to the individual service.

Unless expressly provided otherwise, the introduction of any changes to the Service, and to its use, that would make it usable in a different way from its current form, as well as the launch of new services, shall be governed by the GTC.

You acknowledge and agree that the Website is provided "AS IS" and "AS AVAILABLE" and that Ydu Care therefore assumes no responsibility or liability with respect to the use, enjoyment, or availability of the Website.

In order to be able to use the Website, it is necessary to obtain Internet access. The use of the Website is completely free of charge. Access to the Internet is subject to the terms and conditions between the User and its connectivity provider.

C. RECORDING AND DATA PROTECTION OBLIGATIONS

In order to use certain Services offered by Ydu Care, including but not limited to purchasing and/or booking and/or ordering products or subscribing to the Newsletter/DEM (email marketing), the User is required to register and provide personal data (hereafter referred to as "Registration Data").

The User undertakes to:

a. provide the information and Registration Data requested during the registration process ensuring that it is up-to-date, complete and true;

b. promptly and constantly update the Registration Data so that it is always current, complete and true. If you provide any Registration Data that is untrue, inaccurate, not current or incomplete, or if Ydu Care determines, based on its own discretion, that it is such, Ydu Care will still have the right to deactivate your account. Ydu Care is committed to protecting your privacy and security.

D. INFORMATION ON THE PROTECTION OF PERSONAL DATA

Parmon S.p.A, with registered office in C.da Piraino, S.S.192 Km 73, 95032, Belpasso (CT), in accordance with Article 13 of EU Regulation no. 679/2016 (General Data Protection Regulation), proceeds in its capacity as Data Controller, to process the Registration Data provided upon registration on the yducare.com website and/or other websites that the Company may create over time (hereinafter "Website") and/or other APPs that the Company may create over time (hereinafter: "APP"). The Registration Data will be processed within the limits and in the manner set out in the information provided to the User during registration. For further information on the processing of personal data, please refer to the Privacy Statement as well as the Information on Data Protection in the section "Data Protection".

E. ACCOUNT AND PASSWORD

At the end of the registration procedure for the Service, the User will have his/her own Account, consisting of a confidential User ID ("User Name") and Password. The User is solely and exclusively responsible for the account and therefore for the User Name and Password, also with regard to the activities carried out through their use. You agree to immediately notify Ydu Care of any unauthorized use of your password or username and any other breach of security that you become aware of. The User is aware that, in order to regulate access to the Service, his/her authentication is subject exclusively to verification of the User Name and password used by him/her. You are therefore responsible for the protection and proper use of your User Name and password to access the Service, as well as for any damage or harm that Ydu Care or any third party may suffer as a result of the misuse, loss, misappropriation and/or compromise of the confidentiality of the User Name and password used by you.

Cookies are text files that the Website transfers to the User's computer in order to facilitate navigation. Thanks to cookies, it can be made easier for the Website to recognise the registered User, for instance by avoiding the need for him/her to authenticate (by means of "log-in" and "password") each time he/she accesses the Website. You represent and warrant that you will indemnify and hold harmless Ydu Care, its affiliates, subsidiaries, representatives, employees, and partners from and against any and all claims for damages, including reasonable attorneys' fees, arising out of your connection to or use of the Service caused by your breach of the rules governing its use.

H. PROHIBITION OF TRANSFER AND COMMERCIAL EXPLOITATION OF THE SERVICE

The User undertakes not to reproduce, duplicate, copy, sell, framing, resell or otherwise exploit for commercial purposes the Service or any part thereof, or the use of or access to the Service. The reproduction, even partial, of the contents of the Website is prohibited. Any requests may be assessed at the discretion of the Data Controller.

Ydu Cares reserves the right at all times to modify or disable, temporarily or permanently, the Service (or any part thereof), with or without notice to the User. You acknowledge and agree that Ydu Care shall in no way be liable to you or any third party for any modification, suspension or deactivation of the Service.

The Service may provide links to other websites or resources on the web. The User acknowledges and agrees that Ydu Care can in no way be held responsible for the operation of such external websites or resources. Ydu Care cannot control and is therefore in no way responsible for the content and advertising published on such external websites or resources or for the products or services offered or traded thereon. The User acknowledges and agrees that Ydu Care is in no way responsible or liable, directly or indirectly, for any damages suffered by the User in connection with the content of the websites or in connection with purchases of goods or services made through these websites.

M. ABSENCE OF GUARANTEES BY YDU CARE

The User expressly acknowledges and declares that:

a. Use of the Service is at your sole and exclusive discretion. The Service is provided on an "AS IS" and "AS AVAILABLE" basis and therefore Ydu Care assumes no responsibility or liability with respect to its use and availability, timeliness, deletion, non-delivery or storage of any User communication or customization.

b. Ydu Care does not guarantee:

- that the Service will meet the User's requirements, that the Service will be provided without interruption, on time, securely or error-free;

- the User's expectation that the results obtained from the use of the Service are true and reliable;

- that the quality of the products, services, information or other materials acquired or obtained through the Service will meet the User's requirements, nor that any errors in the Software will be corrected.

c. Any Content downloaded or otherwise obtained from or through the Service is obtained at your sole and exclusive discretion and risk, and that you are solely and exclusively responsible for any damage to your computer equipment or loss of data that results from the download of such materials or the use of the Service.

d. No notice, advice or information, whether written or oral, given to you by Ydu Care or obtained from or through the Service shall imply any warranty not expressly stated in this GTC.

N. COMMUNICATIONS

Any communication between the parties concerning the services of the Website shall be in writing and may be made either by e-mail or by regular mail.

In order to be able to offer you Klarna's payment methods, at checkout we may transmit your personal information in the form of contact and order details to Klarna so that Klarna can assess your suitability for its payment methods and customise these payment methods. 

The transferred user's personal data is processed in line with Klarna's privacy policy.

O. MISCELLANEOUS

These Terms constitute the sole and exclusive agreement between you and Ydu Care and govern your use of the Service, superseding any prior agreements between the parties. Furthermore, the User shall abide by any General Terms and Conditions relating to the use of complementary services (Online Services) or services linked to third-party content or relating to the rules of use of third-party software if he/she is interested in their use. The failure of Ydu Care to exercise a right provided by law or by these GTC shall in no event constitute a waiver of that right. The headings of the articles of the General Terms and Conditions have the sole purpose of making the General Terms and Conditions more convenient to read and have no legal or practical effect. Please report any violations of these GTC to our Customer Service.

ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF USE OF THE SERVICE ("GTC")

Pursuant to and for the purposes of Section 1341(2) of the Civil Code, the User declares that he/she has carefully read and specifically approves the agreements contained in the preceding articles.
